In this Privacy Policy, Vortex Industries LLC & Vortex Colorado LLC (“Vortex”) describes the ways we collect and use the personally identifiable and non-personally identifiable information we may collect through our website, www.vortexdoors.com (the “Site”). This Privacy Policy is only applicable to this Site. Because Vortex does not control how information is collected or used by third-party websites, this Privacy Policy does not apply to the websites of other individuals or entities that contain links to this Site.

By using the Site, you assent to this Privacy Policy. If you do not assent to this Privacy Policy, do not use the Site and do not submit any personally identifiable information through the Site.

Information Vortex Collects

When you choose to share it by submitting it, Vortex may collect the following personally identifiable information through the Site: First Name; Last Name; Email; Phone; Address; City; and Zip Code.

Vortex does not target, market to, or offer its products or services to customers outside the United States. You agree not to submit your personally identifiable information through the Site if you reside outside the United States. If you reside in the European Economic Area, European Union, or Switzerland; submitted personally identifiable information to Vortex through this Site; and want to request a copy of, correct, delete, or limit the ways Vortex uses the information, send an email to info@vortexdoors.com indicating your request. Vortex will use reasonable and appropriate measures to honor your request.

Individual Rights for Site Users Who Reside in California

This following applies to California residents.

California consumers have the right to request that we disclose certain information to them about our collection and use of their personal information during the previous 12 months. Once we receive, confirm, and verify a consumer request, we will disclose the following to the requesting consumer:

  • The categories of personal information we collected about the California consumer in the previous 12 months.
  • The categories of sources for the personal information we collected about the California consumer.
  • Our business purposes for collecting the personal information.
  • The categories of third parties with whom Vortex shared the personal information in the previous 12 months.

Right to Request Deletion

California consumers have the right to request that Vortex delete some or all of the personal information that they submitted through this Site or the Vortex collected while they used this Site, subject to some exceptions. Once Vortex receives, confirms, and verifies a consumer request, we will delete the California consumer’s personal information from our records, unless an exception applies.

Vortex may deny a California consumer’s deletion request if Vortex determines we need to retain the personal information so we or third-party service providers may:

  • Provide a service that you requested.

If you choose to use an authorized agent to make the request for you, Vortex will require the agent to submit proof that you authorized the agent to make the request for you. Vortex will use reasonable and appropriate measures to verify your identity before processing any requests under California law. Specifically, we will ask you to verify information that can be used to link your identity to particular records in our possession, which depends on the nature of your relationship and interaction with us.

Children

Vortex does not target, market to, or offer its products or services to children under the age 13 who are living anywhere in the world. Vortex does not target, market to, or offer its products or services to anyone living outside the United States, which includes children under age 16. If Vortex learns a child under age 13 living in the United States or a child under age 16 living outside the United States submitted through the Site the child’s personally identifiable information without parental consent or Vortex learns it collected information about the child through the Site, Vortex will take reasonable and appropriate steps to delete it.

Assignment

If Vortex sells its assets to or is acquired by another company, or if Vortex merges with another company, you, by using this Site, authorize Vortex to assign the personally identifiable information you provided to Vortex or that Vortex collected while you used this Site.

Email Communications

If you submit your personally identifiable information through this Site, Vortex may send you emails. If you receive an email from Vortex that you did not want to receive or if you want Vortex to stop sending you emails after you receive one from Vortex, notify the email’s sender or follow the unsubscribe instructions in the email. Vortex will use reasonable and appropriate measures to honor your request.

Data Security

Vortex uses reasonable and appropriate measures to safeguard the information you submitted to us through the Site or that Vortex received about you through the Site. You agree by using this Site that you understand that no transmission of information over the Internet can be guaranteed to be totally secure. If you do not want to transmit information to Vortex because Vortex cannot and does not guarantee it will be 100% secure during its transmission, do not submit personally identifiable information through the Site, call us instead.

Data Retention

Vortex will keep your personally identifiable information in its computer systems as long as needed for the purposes described in this Privacy Policy. There may be laws that require Vortex to keep your personally identifiable information for specific time periods.

Do Not Track

This Site may not support your browser software’s Do Not Track setting or feature. Some Internet browsers include the ability to transmit Do Not Track signals that give you control over the collection and use of web browsing information. Since there are no uniform standards for such signals, Vortex does not process or respond to such signals.

Choice/Opt-out

Choice of Law and Forum

By using this Site, you agree that the laws of the United States and the laws of the State of California govern this Privacy Policy and any claim or dispute you may bring against Vortex. You also agree that any arbitration arising from this Privacy Policy will be held in accordance with the Federal Arbitration Act.

Subject to the Dispute Resolution procedure stated below, any legal suit, arbitration, action or proceeding arising out of, or related to, this Privacy Policy or your use of the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of California or before California arbitrators in each case located in the County of Orange, California.

Dispute Resolution

By using this Site, you agree to try to settle any dispute arising from this Privacy Policy with Vortex by sending a letter describing the basis for the dispute and allowing Vortex at least 30 days to respond after Vortex will have received your letter. If you want to send such a letter to Vortex, send it to info@vortexdoors.com. Vortex will respond to you at the address Vortex has on file for you.

You and Vortex agree to attempt to resolve the dispute under the terms described in the preceding paragraph before you or Vortex will commence any litigation or file a claim against the other party.

If a dispute between you and Vortex cannot be resolved using this process, you agree that any dispute arising from this Privacy Policy will be decided by binding arbitration on an individual basis, which means you waive the right for a judge or jury to decide your claims and means that you may not proceed in a class, collective, or consolidated capacity. Your rights during the arbitration process may be more limited than the rights you would have in civil trial or appellate courts. You agree that if a dispute arising from this Privacy Policy will be arbitrated, that it will be exclusively submitted to JAMS (www.jamsadr.com) for binding arbitration under the arbitrator’s rules in the State of California and the parties will mutually agree to a single arbitrator located in the County of Orange, California. You and Vortex also agree the arbitrator will have exclusive authority to resolve any dispute arising from the interpretation, applicability, enforceability, or formation of this Privacy Policy.

Consumers with Disabilities

This Privacy Policy is in a form that is accessible to consumers with disabilities.

Privacy Policy Changes

Vortex may change this Privacy Policy. When Vortex changes it, Vortex will revise the Privacy Policy’s effective date. If Vortex changes the Privacy Policy in a way that will decrease limitations on how Vortex may use the information it collected about you, Vortex will either send a notice email to you at the email address you provided or the email address Vortex has on file for you, or Vortex will publish a notice on the Site, or Vortex will use other reasonable and appropriate measures to notify you of the change.
